根据《中华人民共和国合同法》及有关规定，为明确甲乙双方权利义务关系， 经双方协商一致，签订本合同。
第一条 甲方将_____________市场内________楼________厅______摊位出租给乙方，由乙方在市场内从事经营。
第二条 c期限为_____年。即自二00________年____月____日至二00____年____月____日止。租凭期满后，在同等条件下乙方享有优先承租权。如乙方在发租规定的最后期限届满前____天内还未办理续租手续，即视为放弃优先承租权，甲方有权将摊位另行发租。
第三条 租金、租金的缴纳期限和优惠办法

第四条 甲方权利和义务
（一）甲方权利：
1、制定管理制度及经营公约等，并检查、督促乙方执行；
2、有权对乙方利用所租摊位销售伪劣商品和其他违反国家法律、法规以及损害消费者利益的行为进行教育和管理，并报有关执法部门；
3、在租赁期间因市场内部改造、房屋维修，需对乙方所租赁的摊位进行迁移、拆除时，甲方须提前___ 天书面通知乙方，乙方接到甲方书面通知后须于____天内誊清摊位。甲方尽量给乙方重新安排摊位，乙方愿接受安排的，租金视调整后摊位实际状况重新予以核定。乙方不愿接受安排的，则由甲方退还乙方从拆摊之日起至承租合同期满之日止的摊位租金。租金退还计算方式为：按乙方所缴付的实际租金除以合同规定的承租天数，乘以拆摊之日起至承租合同期满之日止的天数。
（二）甲方义务：
1、不得擅自提前终止合同；
2、提供经营必备的后勤保障设施，如通风设备、照明灯光等，并逐步改善经营条件。
3、对自然原因造成的摊位损坏及照明灯光设施的故障进行维修、更换、保养。
4、维护市场内经营秩序，搞好环境卫生，营造良好的经营环境。
第五条 乙方权利和义务
（一）乙方的权利：
1、依法享有自主经营权；
2、甲方违反规定给乙方造成损失的，乙方有权要求甲方赔偿。
（二）乙方的义务：
1、遵守国家法律、法规和市场内的各项规章制度，合法经营；
2、服从管理，依法按期缴纳各项税费；
3、乙方为所租赁摊位的安全责任人，对该摊位使用安全和防火安全负责，并遵守市场内各项消防安全、用电安全管理规定，不出售有毒、有害、易燃易爆物品，不乱接电源，不违章使用电器，违者承担相应的法律责任；
4、爱护本市场内公共设施、维护摊容、摊貌及市场环境卫生；
5、文明经商、礼貌服务，在指定范围内经营。不出售反动、淫秽、封建、迷信、假冒伪劣商品；不乱堆、乱放、乱挂物品；
6、乙方不得擅自中途退租、转租、转让摊位。乙方若有特殊原因，确需中途退租、转租、转让摊位，需经甲方同意。
第六条 违约责任
1、甲乙双方应履行本合同规定的各自义务，保证合同正常履行；
2、甲方擅自提前终止合同，乙方按摊位租金____ ％向甲方收取违约金；
3、未经甲方书面许可，乙方擅自中途退租、转租、转让，甲方有权提前终止与乙方的租赁合同，并按摊位租金____ ％向乙方收取违约金，同时取消乙方下一轮优先续租资格。
第七条 本合同在履行过程中发生争议，由当事人双方协商解决，协商不成时按下列第___种方式解决：
1、武汉仲裁委员会仲裁；
2、向人民法院起诉。
第八条 本合同未尽事宜，按照国家有关合同法律、法规的规定，由双方协商作出补充规定。补充规定与本合同具有同等效力。
